Terms of Service

The agreement between you and Dutch Discovery when you use the app.

These Terms of Service ("Terms") govern your access to and use of DutchDiscovery, an online application operated by Reaching Expatations.

By creating an account, accessing, or using DutchDiscovery, you agree to these Terms. If you do not agree with these Terms, you should not use the service.

1. About DutchDiscovery

Reaching Expatations is a sole proprietorship registered in the Netherlands.

2. Eligibility

You must be legally capable of entering into a binding agreement to use DutchDiscovery.

If you are under the age of 16, you may only use DutchDiscovery where permitted by applicable law and with the appropriate consent or authorization.

3. Your Account

Some DutchDiscovery features require you to create an account.

You may create an account using supported authentication methods, including Google Sign-In.

When using Google Sign-In, you authorize Google to provide DutchDiscovery with the basic account and profile information necessary to authenticate your account, as described in our Privacy Policy.

You are responsible for maintaining the security of your account and for notifying us if you believe that your account has been accessed without authorization.

You must not:

  • Create an account using false or misleading information;
  • Impersonate another person;
  • Share your account with others where this is not permitted;
  • Attempt to gain unauthorized access to another user's account; or
  • Use DutchDiscovery for unlawful or fraudulent purposes.

4. Use of the Service

You may use DutchDiscovery only for lawful purposes and in accordance with these Terms.

You must not:

  • Attempt to interfere with or disrupt the operation of DutchDiscovery;
  • Circumvent security or access controls;
  • Reverse engineer or improperly access parts of the service that are not intended for public access, except where such restriction is prohibited by applicable law;
  • Introduce malicious software or code;
  • Use automated methods to abuse the service;
  • Copy, reproduce, distribute, or commercially exploit protected content without authorization; or
  • Use the service in a way that violates applicable law or the rights of others.

5. Intellectual Property

Unless otherwise stated, DutchDiscovery, including its software, design, branding, text, graphics, educational materials, databases, and other content, is owned by or licensed to Reaching Expatations.

Using DutchDiscovery does not transfer ownership of any intellectual property to you.

You may use the service and its content only as permitted by these Terms or applicable law.

You may not reproduce, redistribute, sell, sublicense, modify, or commercially exploit DutchDiscovery content without prior written permission, unless permitted by law.

6. User Content

If DutchDiscovery allows you to submit, upload, publish, or otherwise provide content, you remain responsible for that content.

You represent that you have the necessary rights to provide the content and that doing so does not violate applicable law or the rights of another person.

You grant Reaching Expatations a limited, non-exclusive right to process and display such content only as reasonably necessary to operate and provide the relevant functionality of DutchDiscovery.

We may remove content that violates these Terms or applicable law.

7. Subscriptions and Payments

Certain features of DutchDiscovery are available through paid subscriptions.

DutchDiscovery may offer subscriptions on a monthly or annual basis. The applicable price, billing interval, and subscription features will be clearly displayed before you complete your purchase.

7.1 Automatic Renewal

Subscriptions are recurring and automatically renew at the end of each applicable billing period unless cancelled before the next renewal.

A monthly subscription renews approximately every month, and an annual subscription renews approximately every year, according to the billing cycle established when the subscription begins.

By subscribing, you authorize Link and its payment services provider, Stripe, to charge the applicable subscription fee using your selected payment method for each renewal until you cancel the subscription.

7.2 Payment Processing Through Link and Stripe

Payments and subscriptions for DutchDiscovery may be processed through Link and Stripe, including Stripe's payment and subscription services.

Where the "Sold through Link" or comparable Stripe-managed payment service is used, Stripe may act as the merchant of record on behalf of Reaching Expatations and may provide payment processing, subscription management, renewal, refund, and related customer-support services.

Your use of Link is also subject to Link's applicable terms and privacy policy.

The Link terms and privacy policy are separate from these Terms of Service and govern the relationship between you and Link in relation to Link's own payment and consumer services.

7.3 Cancellation

You may cancel your subscription before its next renewal date.

Unless otherwise stated at the time of cancellation or required by applicable law, cancellation will take effect at the end of the current paid billing period. You will generally retain access to paid features until the end of the period for which you have already paid.

Cancelling your subscription prevents future renewal charges but does not automatically refund payments already made for the current billing period, except where a refund is required by applicable law or expressly provided by Reaching Expatations or Link.

Where available, subscription management and cancellation may be handled through your Link account or the subscription-management functionality provided through DutchDiscovery.

7.4 Failed Payments

If a recurring payment cannot be completed, Link or Stripe may attempt to recover the payment using their applicable payment-recovery procedures.

If payment remains unsuccessful, access to paid DutchDiscovery features may be suspended or terminated.

The handling of failed payments, retries, and related notifications may depend on the payment and subscription settings applicable to your subscription.

7.5 Refunds

Refunds are handled in accordance with applicable law and the applicable refund policies of Reaching Expatations and, where relevant, Link or Stripe.

Nothing in these Terms limits any mandatory consumer rights concerning refunds, cancellation, digital services, or payment transactions.

8. Consumer Rights and Right of Withdrawal

Nothing in these Terms limits or excludes mandatory consumer rights under applicable law.

If you are a consumer in the European Union, you may have statutory rights concerning digital services, subscriptions, conformity, cancellation, refunds, and other consumer protections.

Where applicable, consumers may have a statutory 14-day right of withdrawal for contracts concluded online.

For digital services that begin immediately after purchase, the right of withdrawal may be affected by specific statutory conditions and exceptions.

Where required by applicable law, we will provide the required information and obtain the required consent before immediate delivery of a digital service begins.

Where mandatory consumer rights apply, those rights take precedence over any conflicting provision of these Terms.

9. Third-Party Services

DutchDiscovery may integrate with or rely on third-party services, including:

  • Google for authentication;
  • Lovable Cloud and related infrastructure providers for hosting, database, authentication, and application functionality; and
  • Link and Stripe for payment processing and subscription services.

Your use of third-party services may also be subject to their own terms and policies.

We are not responsible for the independent operation, availability, or policies of third-party services, except to the extent required by applicable law.

10. Availability and Changes

We aim to keep DutchDiscovery available and functional, but we do not guarantee uninterrupted or error-free availability.

We may temporarily suspend the service for maintenance, security, upgrades, or other operational reasons.

We may modify, add, or remove features from DutchDiscovery where reasonably necessary to improve, maintain, or develop the service.

If a material change significantly affects a paid service, we will provide notice where required by applicable law.

11. Privacy

Your use of DutchDiscovery is also governed by our Privacy Policy.

The Privacy Policy explains what personal data we collect, how we use it, how we store it, and how we work with third-party service providers.

12. Disclaimer

DutchDiscovery is provided for general informational, educational, and service-related purposes.

While we make reasonable efforts to provide accurate and useful information, we do not guarantee that all information available through DutchDiscovery is complete, current, or error-free.

Information provided through DutchDiscovery should not be considered legal, financial, immigration, medical, or other professional advice unless explicitly stated otherwise.

You are responsible for determining whether information is appropriate for your particular circumstances.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Reaching Expatations will not be liable for indirect, incidental, consequential, or special damages arising from your use of or inability to use DutchDiscovery.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

For consumers, mandatory statutory rights remain unaffected.

14. Suspension and Termination

We may suspend or terminate your access to DutchDiscovery if you materially violate these Terms, engage in fraudulent or unlawful activity, or pose a security or operational risk to the service.

You may stop using DutchDiscovery at any time.

If you have an active paid subscription, closing or deleting your DutchDiscovery account does not necessarily cancel a separately managed subscription. Where applicable, you should cancel your subscription through the available subscription-management functionality.

Where appropriate, we will provide reasonable notice before terminating access, except where immediate action is necessary for legal, security, fraud-prevention, or operational reasons.

15. Governing Law

These Terms are governed by the laws of the Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.

Any disputes will be handled by the competent courts in the Netherlands, subject to any mandatory jurisdiction rights applicable to consumers.

16. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice.

Your continued use of DutchDiscovery after the updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
